Terms & Conditions

1. Scope
These terms and conditions apply to all deliverables and performance by AMLA Natur Vertriebs GmbH to consumers (as defined by German law § 13 BGB).

2. Contracting Party
The sales agreement is made with: AMLA Natur Vertriebs GmbH, General Manager: Buko Hartmann, Butterberg 3, 21279 Drestedt, Germany . Our customer service is available for questions and complaints Monday thru Friday from 9:30 am until 1:00 pm and 2:30 pm until 5:30 pm by phone at +49 (0) 4186-88799-0 or by e-mail at service@ayurveda-markt.de.

3. Offering and Conclusion of the Contract
3.1 The presentation of the products in the online shop is not a legally binding offer, but an invitation to place an order. All offers hold "while supplies last", unless the products are annotated differently. Errors excepted.

3.2 By clicking the button 'Send Order' in the final step of the ordering process you place a binding order for the merchandise contained in the shopping cart. The sales agreement is brought about when we accept your order with an order confirmation by e-mail immediately after we have received your order.

3.3 You have the option to conclude the sales agreement in German or English language.

4. Right to Cancel

If you are a consumer, you may cancel the contract within seven working days, starting the day after you have received the goods, without having to give any reason. However this period will not start before all information obligations laid down in the "Consumer Protection (Distance Selling) Regulations 2000" have been fulfilled. You may cancel by giving us notice in any of the following ways: by written notice sent to us by post, by fax, by e-mail. You must address the cancellation to:

Consequences of Cancellation
Prior to the cancellation, you shall retain possession of the goods and take reasonable care of them. You must return any goods supplied at your own expense if you cancel the contract. You are under the duty to take reasonable care to see that the returned goods are received by the supplier and not damaged in transit, but in other respects your duty to take care of the goods shall cease once you send them. You will be reimbursed for all amounts you have paid within thirty days after the supplier has received your notice of cancellation.

Exemptions
The right to cancel does not apply to distance contracts for the delivery of audio or video recordings or software if the delivered data carriers have been unsealed by the consumer.

Sie können Ihre Vertragserklärung innerhalb von 14 Tagen ohne Angabe von Gründen in Textform (z.B. Brief, Fax, E-Mail) oder - wenn Ihnen die Sache vor Fristablauf überlassen wird - auch durch Rücksendung der Sache widerrufen. Die Frist beginnt nach Erhalt dieser Belehrung in Textform, jedoch nicht vor Eingang der Ware beim Empfänger (bei der wiederkehrenden Lieferung gleichartiger Waren nicht vor Eingang der ersten Teillieferung) und auch nicht vor Erfüllung unserer Informationspflichten gemäß Artikel 246 § 2 in Verbindung mit § 1 Absatz 1 und 2 EGBGB sowie unserer Pflichten gemäß § 312g Absatz 1 Satz 1 BGB in Verbindung mit Artikel 246 § 3 EGBGB. Zur Wahrung der Widerrufsfrist genügt die rechtzeitige Absendung des Widerrufs oder der Sache. Der Widerruf ist zu richten an:

Widerufsfolgen
Im Falle eines wirksamen Widerrufs sind die beiderseits empfangenen Leistungen zurückzugewähren und ggf. gezogene Nutzungen (z.B. Zinsen) herauszugeben. Können Sie uns die empfangene Leistung sowie Nutzungen (z.B. Gebrauchsvorteile) nicht oder teilweise nicht oder nur in verschlechtertem Zustand zurückgewähren beziehungsweise herausgeben, müssen Sie uns insoweit Wertersatz leisten. Für die Verschlechterung der Sache und für gezogene Nutzungen müssen Sie Wertersatz nur leisten, soweit die Nutzungen oder die Verschlechterung auf einen Umgang mit der Sache zurückzuführen ist, der über die Prüfung der Eigenschaften und der Funktionsweise hinausgeht. Unter "Prüfung der Eigenschaften und der Funktionsweise" versteht man das Testen und Ausprobieren der jeweiligen Ware, wie es etwa im Ladengeschäft möglich und üblich ist. Paketversandfähige Sachen sind auf unsere Gefahr zurückzusenden. Sie haben die regelmäßigen Kosten der Rücksendung zu tragen, wenn die gelieferte Ware der bestellten entspricht und wenn der Preis der zurückzusendenden Sache einen Betrag von 40 Euro nicht übersteigt oder wenn Sie bei einem höheren Preis der Sache zum Zeitpunkt des Widerrufs noch nicht die Gegenleistung oder eine vertraglich vereinbarte Teilzahlung erbracht haben. Andernfalls ist die Rücksendung für Sie kostenfrei. Nicht paketversandfähige Sachen werden bei Ihnen abgeholt. Verpflichtungen zur Erstattung von Zahlungen müssen innerhalb von 30 Tagen erfüllt werden. Die Frist beginnt für Sie mit der Absendung Ihrer Widerrufserklärung oder der Sache, für uns mit deren Empfang.

Ausschluss
Das Widerrufsrecht besteht nicht bei Fernabsatzverträgen zur Lieferung von Audio- oder Videoaufzeichnungen oder von Software, sofern die gelieferten Datenträger vom Verbraucher entsiegelt worden sind.

5. Prices and Shipping Costs
5.1 The prices listed on the product pages contain lawful sales tax and other price components.

5.2 There is a link to the shipping cost overview on the product pages and in the shopping cart right next to the posted prices of the items. After choosing the shipping method, the exact shipping costs are once more clearly communicated on the order confirmation page.

5.4 There are no further taxes or costs.

6. Shipping
6.1 We ship to all countries of the European Union except Malta and Cyprus. Our service partner is DPD.

7. Payment
7.1 There is a choice of payment by direct debit, PayPal or credit card. In addition standard shipments to Germany can be paid with cash on delivery.

7.2 With payment by cash on delivery there is a processing fee. When choosing this payment method the fee is clearly pointed out. After choosing this payment method, the fee is once more clearly communicated on the order confirmation page.

7.3 You only have a right to offset, if your counterclaims were legally confirmed or uncontested before a German court of law or were accepted by us in writing.

7.4 You only have a right of retention, if your claims are based on the same contractual relationship.

8. Reservation of Proprietary Rights
The merchandise remains our property until paid in full.

9. Warranty
The warranty is given according to German law. For all deficiencies that arise during the legal warranty period of two years form delivery, you have the legal right for supplementary performance (your choice of: removal of defects or replacement) and - if the legal requirements are met - the legal rights for reduction in price or withdrawal from contract as well as damages.

10. Disclaimer
AMLA Natur Vertriebs GmbH does not assume liability for damages or intolerableness, particularly allergic reactions, that are caused by the use of the merchandise or are related to it, except if there has been deliberation or gross negligence on our part.
